Judge: Albuquerque police owe damages, fees in shooting case

ALBUQUERQUE, N.M. (AP) — A state district judge says the Albuquerque Police Department owes damages and fees to a law firm for withholding documents related to the 2014 shooting death of a woman during an auto-theft investigation. The Albuquerque Journal reports (http://bit.ly/2wSNXKI ) that the amount the department will have to pay has yet to be determined, but Judge Nancy Franchini said Wednesday the department must produce the documents that had been requested under the Inspection of Public Records Act. Attorney Shannon Kennedy represents the family of Mary Hawkes in a wrongful death civil lawsuit. Her preliminary fees top $103,000 and state law allows a $100-per-day fine for violations of the records law. Jeremy Dear, the former officer who shot the 19-year-old, won his own civil lawsuit against the department.
